These Terms and Conditions (the "Terms") are a binding agreement between you and ConnectAble LLC ("ConnectAble", "we", "us", "our") governing your access to and use of the website at pickleball.connectable.work (the "Site") and your participation in, sponsorship of or attendance at The ConnectAble Classic pickleball tournament (the "Event"), produced by ConnectAble in partnership with Sarasota Center Boulevard Pickleball Club (the "Venue"). Read them carefully. They include a mandatory arbitration agreement, a class-action waiver, a limitation of liability and a release of claims.
1. Acceptance of These Terms
By accessing the Site, creating an account, registering a team, joining a roster, purchasing a sponsorship package, or entering the Event premises, you accept these Terms and our Privacy Policy in full. If you do not agree, do not use the Site and do not register. If you accept these Terms on behalf of a company, organisation or another person, you represent that you have authority to bind them, and "you" includes both you and that party.
2. Eligibility
Competitors must be at least fourteen years old on the day of the Event. Any competitor under eighteen must be registered by, and have their waiver accepted by, a parent or natural guardian, who assumes joint and several responsibility for that minor's compliance with these Terms. You must provide accurate, current and complete information and keep it updated. We may refuse, suspend or cancel any registration, account or sponsorship at our discretion, including for false information, non-payment, chargeback, abusive conduct or breach of these Terms.
3. Registration, Teams and Rosters
- A team consists of four competitors. Team captains create the team, invite roster members and choose whether the captain pays the full team fee or each member pays their own share.
- Roster invitations are delivered as single-use magic links. A magic link is a bearer credential: anyone holding it can complete that participant's registration. Do not forward it. You are responsible for all activity carried out through a magic link issued to you.
- Captains may promote roster members to co-captain. Co-captains have the same ability to edit team details and manage the roster as the captain, and the captain remains responsible for everything they do.
- T-shirt sizes lock permanently after the published gear-size freeze date so that fulfilment orders can be placed. We are not obliged to accommodate size changes after that date.
- Every player must accept the digital waiver before check-in closes. No waiver, no play, no refund.
4. Fees, Payment and No-Refund Policy
Entry is a flat fee per competitor, or the published team rate for a full four-person team, plus any applicable taxes. Sponsorship packages are priced as shown on the Site. All prices are in US dollars. Payments are processed by Stripe, and your use of that checkout is additionally subject to Stripe's own terms. We may correct pricing errors and cancel any transaction affected by an obvious error, refunding any amount actually captured.
ALL SALES ARE FINAL. Entry fees, team fees and sponsorship payments are non-refundable and non-transferable under all circumstances, including no-shows, injury, illness, withdrawal, disqualification, ejection for misconduct, weather, and postponement or relocation of the Event. Initiating a chargeback on a valid charge is a breach of these Terms and we may recover the disputed amount, the processor's dispute fee and our reasonable collection costs.
5. Sponsorship Packages
- Package benefits are described on the Site and are delivered on a commercially reasonable efforts basis. Print-dependent benefits such as t-shirt, banner and flyer placement require artwork to reach us by the production deadline we communicate; artwork received late may be omitted with no reduction in price.
- Certain packages include one free four-person team entry. Included team entries are stated on the package, are non-transferable for cash, and expire unused if not claimed before the Event.
- Sponsors grant ConnectAble and the Venue a non-exclusive, worldwide, royalty-free licence to reproduce and display their name, logo, trade marks and brand assets in Event and post-Event materials in any medium, for the duration of the Event campaign and in perpetuity for archival, recap and portfolio use. Sponsors warrant they own or are licensed to grant these rights and will indemnify us against any claim to the contrary.
- Trade and in-kind sponsorships take effect only once confirmed in writing by ConnectAble. Goods and services must be delivered to the standard and by the date agreed; undelivered in-kind commitments release us from the corresponding benefits.
- Sponsorship confers no ownership, partnership, joint venture, agency or employment relationship, no editorial control over Event content, and no right to approve how the Event or its media are produced.
- Sponsorship payments are commercial marketing expenditure, not charitable donations, and are not tax-deductible as charitable contributions. A portion of Event proceeds is granted to our 501(c)(3) nonprofit partner. Consult your own tax adviser; we give no tax advice.
6. Intellectual Property — ConnectAble Ownership
The Site and everything in it is owned by ConnectAble or its licensors and is protected by United States and international copyright, trade mark, trade dress, patent, trade secret and unfair competition law.
- ConnectAble exclusively owns all right, title and interest in and to the Site, its source code, object code, databases, schemas, APIs, design system, layout, look and feel, graphics, illustrations, iconography, photography and video commissioned or produced for the Event, written copy, rules, scoring format, package structures, tournament concept and all documentation.
- "ConnectAble", "The ConnectAble Classic", the ConnectAble logo and all related names, logos, slogans, product and service names are trade marks of ConnectAble or its partners. Nothing on the Site grants any licence or right to use them. You may not use them without our prior written permission.
- ConnectAble also owns all compilations, aggregations, edits, recaps, highlight reels, derivative works, analytics and anonymised or aggregated data sets that it creates, including those created from or incorporating User Content, together with all improvements, feedback and suggestions you submit, which you assign to us on submission without compensation.
- No right is granted by implication, estoppel or otherwise. All rights not expressly granted to you in these Terms are reserved by ConnectAble.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-sublicensable, non-transferable licence to access and view the Site for your own personal, non-commercial use in connection with the Event. You may not copy, reproduce, republish, frame, scrape, crawl, mirror, data-mine, reverse engineer, decompile, create derivative works from, sell, licence or otherwise exploit any part of the Site.
7. Your Content and the Licence You Grant Us
"User Content" means anything you submit, upload or display through the Site or the Event, including team names, taglines, team logos and images, call-to-action links, roster information, photographs, and messages.
You keep whatever ownership you already had in your own User Content. Nothing in these Terms transfers ownership of your pre-existing trade marks or original works to us, and nothing in this section limits ConnectAble's exclusive ownership of the Site and the Materials described in Section 6.
By submitting User Content you grant ConnectAble and the Venue a perpetual, irrevocable, worldwide, non-exclusive, fully paid-up, royalty-free, transferable and sublicensable licence to host, store, reproduce, modify, adapt, edit, translate, publish, publicly perform, publicly display, distribute and otherwise use that User Content, in whole or in part, in any medium now known or later developed, for any purpose connected with operating, promoting, fundraising for, reporting on or commercialising the Event, ConnectAble and the Venue, without notice, attribution, approval or compensation. To the fullest extent permitted by law you waive any moral rights and any right of approval in respect of that use. Any edited, compiled or derivative work we create from your User Content is owned by ConnectAble.
You represent and warrant that you own or have all rights necessary to grant this licence, that your User Content does not infringe any third party's intellectual property, privacy or publicity rights, and that it is not unlawful, defamatory, obscene, hateful, harassing, deceptive or otherwise objectionable. We may refuse, remove, edit or disable any User Content at any time, for any reason or no reason, without liability, and we have no obligation to monitor, store or return it.
8. Assumption of Risk, Waiver and Media Release
Pickleball is a physical sport with inherent risks and can result in property damage, serious bodily injury, permanent disability, paralysis and death. Every competitor must accept the Assumption of Risk, Release of Liability and Waiver of Claims Agreement presented during registration. That agreement is incorporated into these Terms by reference, applies in addition to these Terms, and controls in the event of any conflict on matters of on-site physical risk, release and arbitration. Spectators and guests enter the Venue at their own risk and are bound by all Venue rules and staff instructions.
You consent to being photographed, filmed and recorded at the Event and grant the media licence described in Section 5 of our Privacy Policy and in the waiver.
9. Tournament Rules and Code of Conduct
The published tournament rules, including the ten-point scoring rule, the video-validation requirement and the time limits, form part of these Terms and may be clarified or adjusted by the organisers where necessary for fairness or safety. Decisions of the organisers and judges on scoring, eligibility and conduct are final. Arguing, fighting, unsportsmanlike conduct, running in the facility, ignoring staff instructions, falsifying scores or submitting fraudulent video proof may result in immediate disqualification of the individual or the entire team and removal from the premises, without refund.
10. Acceptable Use of the Site
You agree not to: access another person's account, roster or magic link without authorisation; probe, scan or test the vulnerability of the Site or breach any security or authentication measure; use bots, scrapers or automated means to access the Site or harvest data; transmit malware, spam or unsolicited commercial messages; interfere with or place unreasonable load on our infrastructure; impersonate any person or entity; or use the Site for any unlawful purpose or in violation of any applicable law, export control or sanctions regime.
11. Third-Party Services
The Site integrates Stripe for payments, Base44 for application data, authentication and transactional email, GoHighLevel for contact management, and Railway and Cloudflare for hosting and delivery. It also links to sponsor and team destinations we do not control. We are not responsible for the availability, content, accuracy, security or practices of any third-party service or site, and your dealings with them are solely between you and them.
12. Disclaimer of Warranties
THE SITE, THE EVENT AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONNECTABLE AND THE VENUE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, that the Site is free of harmful components, or that any particular prize, benefit, sponsor deliverable, attendance level or fundraising outcome will be achieved.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER CONNECTABLE, THE VENUE, NOR THEIR RESPECTIVE OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, AGENTS, SPONSORS, LICENSORS OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO THE SITE, THE EVENT OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE EVENT OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and in those jurisdictions our liability is limited to the smallest extent permitted by law.
14. Indemnification
You agree to defend, indemnify and hold harmless ConnectAble, the Venue and their respective owners, members, officers, directors, employees, contractors, volunteers, agents and licensors from and against any claim, demand, action, liability, damage, loss, cost or expense, including reasonable attorneys' fees and court costs, arising out of or relating to your use of the Site, your participation in or attendance at the Event, your User Content, your breach of these Terms or of any law, or your violation of any third party's rights. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence.
15. Changes, Cancellation and Force Majeure
We may change the Event date, start time, format, scoring, routes, prizes, venue layout or any other aspect at any time. We may cancel, postpone, shorten or relocate the Event. Neither ConnectAble nor the Venue is liable for any failure or delay in performance caused by circumstances beyond reasonable control, including acts of God, severe weather, hurricane, flood, fire, epidemic or pandemic, public health order, government action, utility or facility failure, labour dispute, act of terrorism or civil unrest. Fees remain non-refundable in all such cases, and we have no liability for travel, accommodation or other incidental costs you incur.
16. Termination
We may suspend or terminate your access to the Site or your registration at any time, with or without notice, for any reason, including breach of these Terms. On termination, your licence to use the Site ends immediately. Sections 4, 6, 7, 8, 12, 13, 14, 17 and 18, and every other provision that by its nature should survive, survive termination.
17. Governing Law, Arbitration and Class-Action Waiver
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act as to arbitrability. You and ConnectAble agree first to attempt in good faith to resolve any dispute informally by written notice, and then through mediation. Any dispute, controversy or claim that is not resolved that way will be finally settled by binding arbitration seated in Sarasota County, Florida, conducted in English, before a neutral arbitrator or, where the participant waiver so requires, a three-member panel.
YOU AND CONNECTABLE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity. If the class-action waiver is found unenforceable as to a particular claim, that claim alone is severed and heard in court in Sarasota County, Florida, and the remainder stays in arbitration.
Any claim arising out of or relating to the Site, the Event or these Terms must be filed within one year after the claim arose, or it is permanently barred, except where a shorter or longer period is mandated by non-waivable law. Either party may bring an individual action in small claims court, and either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
18. General
These Terms, the Privacy Policy and the participant waiver are the entire agreement between you and ConnectAble regarding the Site and the Event, and supersede all prior understandings. If any provision is held invalid or unenforceable, it is modified to the minimum extent necessary or severed, and the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them freely, including in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship. Notices to us must be sent to info@connectable.work; notices to you may be sent to the email address on your registration or posted on the Site. We may update these Terms at any time by posting a revised version with a new effective date, and your continued use of the Site or participation in the Event after that date constitutes acceptance.
